Terms of Service

Penguinier (“Penguinier”, “we”) operates an agent-first marketplace at penguinier.com: you describe what you need to a personal shopping agent, and it recommends items from a curated catalog of independent sellers. By creating an account or placing an order you agree to these terms.

The service

  • Recommendations are made by an AI shopping agent reasoning over verified catalog metadata and cited manufacturer claims. The agent is instructed to be candid — including telling you when our catalog isn't the right answer — but it is software, and you are responsible for your purchase decisions.
  • No order is placed without your explicit confirmation, and every total is independently re-validated by our servers before an order exists.
  • Products are sold by independent sellers unless a listing is explicitly labeled as sourced by Penguinier. Sellers commit to shipping windows that we measure against real order timestamps.

Your account

  • You must provide a real email address and keep your credentials secure. Accounts registered by automated means may be removed.
  • Your conversations with the shopper are stored to provide the service, including the agent's per-buyer memory — which you can view, edit, and delete from your Account page at any time.
  • We may suspend accounts that abuse the service, attempt to manipulate the agent, or violate these terms.

Orders and payment

  • Prices are shown in USD. An order exists only after your explicit confirmation and our server-side validation of the total.
  • Returns and remedies are governed by our Returns policy.

Sellers

Selling on Penguinier is governed by the Seller Agreement. Placement is earned through the quality bar and measured reliability — it is never sold.

Liability

The service is provided as-is. To the maximum extent permitted by law, Penguinier's liability for any claim arising from the service is limited to the amount you paid for the order giving rise to the claim. Nothing in these terms limits liability that cannot be limited by law.
